Open market economy

This is open market economy, isn't it? "Good, hard-working people" sent to prison!

This sentence appeared as the quotation of the day in the New York Times of May 24, 2008.

My own comment on my own post. I was outraged when I read that quoation. Too much talk about open market economy but reality shows how fallacious that is. Rich countries are providing subsidies to their farmers. Something developing countries cannot afford.

Now a USA judge admits that open labor market does not exist for good, hard-working people, simply because they cross an invisible line called national border.

Isn't this a philosophical incoherence with the constitution and the laws that prohibit discrimination against national origin?
